Lessons Learned From Midterm Exams

Quitters Never Win. Stick to FACTS, Not Drama, Not Ego.

For those who missed the midterms or did not do so well on the midterms, remember that it's only 15% of your overall grade of 120%. So... do a better job on your assignments (which are posted MORE THAN ONE MONTH IN ADVANCE) and ACE your finals. You should be just fine. Don't give up on yourself.

Strategy to remember numbers

For short numbers, like a PIN number, try to play with the component numbers mentally and create some kind of memorable link between them or 'picture' of them. Just as an illustration of what I mean, take the easy case of 1230 which could be remembered as 'lunchtime' or of 4007 which could thought of as 'collecting money for James Bond'. Get the general idea?

For longer numbers, the best method is called 'chunking'. You break up the number into smaller and more memorizable chunks. For example, remembering the number 472627607 is easier if one remembers it as 472 627 607 or as 47 26 27 607. Play with the original number and see which chunks best help you to remember it.

EXAM STRATEGIES

Five important points to remember during exam:

UK study urges equal crew pay

A BRITISH government report today recommended an end to nationality-based pay for seafarers on UK ships. The report considered whether the government should outlaw the practice of differential pay altogether or allow owners to pay rates based on the cost of living in the home countries of foreign crew members. Speaking today in Parliament, new shipping minister Mike Penning said: “The issues raised by those who submitted evidence are important and the government wishes to provide interested parties the opportunity to comment on this review of evidence before reaching conclusions on how to proceed.” The public has a fortnight to react to the report. Mark Dickinson, general secretary of seafarers’ union Nautilus International, welcomed the report and its recommendation that nationality-based pay be outlawed. “This issue has dragged on for far too long, and we hope that it can now be quickly resolved.”

Strategic Alliance

To realize the most from strategic alliance, companies should observe 5 guidelines -

1. Pick a compatible partner; take the time to build strong bridges of communication and trust and don't expect immediate payoffs.

2. Choose an ally whose products and market strongholds complement rather than compete directly with the company's own product and company base.

3. Learn thoroughly and rapidly about a partner's technology and management; transfer valuable ideas and practices into one's own operation promptly.

4. Be careful not to divulge competitively sensitive information to a partner.

5. View the alliance as temporary (5 to 10 years); continue longer if it's beneficial but don't hesitate to terminate the alliance and go it alone when the payoffs run out.

Transocean Deepwater Horizon Disaster

President Obama has finally decided that it might be a good idea to talk with BP executives, including CEO Tony Hayward. A meeting is scheduled at the White House for next week Wednesday, June 16. Yesterday, Obama met with family members of those who died in the initial explosion of the Transocean Deepwater Horizon oil rig. Given that President Obama is a law professor, and most of his advisors are lawyers, it came as a surprise to them that a piece of maritime law, the Death on the High Seas Act (DOHSA), limits the amount of compensation of a death caused by wrongful acts beyond the 3-mile limit.

Under DOHSA, survivors are limited to a cash amount based solely on what a victim may have earned in life, or ‘pecuniary’ damages. Non-pecuniary damages, such as funeral expenses, grief and suffering, compensation for children, are not covered. Such was the case in 1996 concerning TWA Flight 800 when it crashed 8 miles off of Long Island. A panel of judges ruled in favor of the families of the crash victims, since in 1988, President Ronald Reagan extended the distance to international waters to 12 miles, therefore the crash did not occur on the “high seas”. It may be interesting to note that now Supreme Court Justice Sotomayor dissented, claiming that the 3-mile rule still applied.

Another maritime law, also from 1920, is a stumbling block to the clean-up efforts. Over a dozen nations have offered assistance, as they have equipment and experience in cleaning oil spills. However, the Jones Act prohibits foreign operations in the Gulf of Mexico. Known as Section 27 of the Maritime Act of 1920, the Jones Act deals with ‘cabotage’, or coastal shipping. The act is meant to protect the U.S. maritime industry such that only U.S. flagged vessels, crewed by at least 75% U.S. citizens, conducting commercial operations in U.S. waters. In 2005, the Bush administration waived the Jones Act in the wake of Hurricane Katrina.

BP is not blameless. To what extent their responsibility is in the actual accident will need to be determined later. But for now, they have been doing all they can, as quickly as they can in regards to the well head one mile below the surface. However, in regards to the oil spill, there has been a tragedy of errors on many levels, from BP to the Federal government.

Crew regain control of ship from sleeping pirates

The crew of a Libyan-owned cargo ship disarmed their sleeping Somali captors yesterday, killing five of them to regain control of their vessel that had been hijacked almost three months earlier, officials said. A sixth pirate managed to lock himself in a room and call other pirates before the crew took him hostage. The EU anti-piracy force sent the closest warship to provide assistance. A group of pirates on another hijacked vessel tried to block the warship, but when the warship's helicopter approached the pirates changed course. The MV Rim was seized on 3 February in the Gulf of Aden.

STCW revision must address fatique

Fatigue, on many types of ship, is a major problem, if not an absolute scandal, one that could rebound upon the industry , much as did its use of asbestos, if the premature death of seafarers can be associated with their working practices, which is not without the realms of possibility.But almost as important is the failure to accept that in the 21st century, it is no longer acceptable to have exhausted people, whose brains are barely functioning, controlling enormous mobile pieces of machinery operating in a hostile environment. It is unacceptable in the skies, on the roads, in factories and in public transport, and it remains a matter of some curiosity that a similar attitude does not prevail on the seas.
